Bisphenol S (BPS) Added to Proposition 65 List

Recently, the California Office of Environmental Health Hazard Assessment (OEHHA) has added Bisphenol S (BPS) to the list of known reproductive toxic chemicals in California Proposition 65.
BPS is a bisphenol chemical substance that can be used to synthesize textile fibers and improve the color fastness of certain fabrics. It can also be used to make hard plastic items. BPS can sometimes serve as a substitute for BPA.
It is worth noting that several recent settlement agreements regarding the use of Bisphenol A (BPA) in textile products, such as socks and sports shirts, including in the reproduction agreement, all mention that BPA cannot be replaced by any other bisphenol like substance (such as Bisphenol S).
California OEHHA has identified BPS as a reproductive toxic substance (female reproductive system). Therefore, OEHHA will add Bisphenol S (BPS) to the chemical list in California Proposition 65, effective December 29, 2023. The exposure risk warning requirements for BPS will take effect on December 29, 2024, with a 60 day notice and subsequent settlement agreement.

California Proposition 65 (Prop 65) is the ‘Safe Drinking Water and Toxic Enforcement Act of 1986’, a ballot initiative passed overwhelmingly by Californian residents in November 1986. It requires the state to publish a list of chemicals that are known to cause cancer, birth defects or reproductive harm. First published in 1987, the list has evolved to approximately 900 chemicals.

Under Prop 65, companies doing business in California are required to provide a clear and reasonable warning before knowingly and intentionally exposing anyone to a listed chemical. Unless exempt, businesses have 12 months to comply with this Prop 65 provision once a chemical is listed.
