On February 20, 2025, California proposed Senate Bill AB 1148, also known as the “Safer Food Packaging Act of 2025,” aimed at regulating antimony trioxide, bisphenol A, and phthalates in food packaging.
The proposed law will add content to Chapter 15 of Part 104, Section 3 of the state’s Health and Safety Act (starting with Section 109015) regarding product safety. According to this legal document, food packaging refers to non durable packaging, packaging components, or tableware used for containing, providing, storing, processing, protecting, or selling food, food products, or beverages. Food packaging “includes food or beverage containers, takeaway food containers, unit product boxes, liners, packaging paper, service containers, tableware, straws, food boxes, as well as disposable plates, bowls, or trays.
Implementation time
Starting from January 1, 2027, no one is allowed to distribute, sell, or offer for sale food packaging containing any of the following chemicals in the state:
●Phthalates (including but not limited to BBP, DBP, DCHP, DEP, DEHP, DIBP, DIDP, DIHP, DINP, DnHP, DNOP, and DnPP)
●Bisphenol: BPA, BPB, BPS, BPF or BPAF, or related compounds
●Antimony trioxide.
Note:
Those who violate this regulation shall bear a civil fine of no more than 5000 yuan (5000 US dollars) for the first violation, and a civil fine of no more than 10000 yuan (10000 US dollars) for each subsequent violation.
