TPCH in the United States releases guidelines for PFAS and Phthalates

In November 2023, the US TPCH regulation issued a guideline document on PFAS and Phthalates in packaging. This guide document provides recommendations on testing methods for chemicals that comply with packaging toxic substances.

In 2021, regulations will include PFAS and Phthalates under control and prohibit their intentional use in packaging and its supply chain. Meanwhile, each state has made adjustments to existing laws or enacted new laws and regulations to prohibit toxic and harmful substances in packaging. Recently, many states have banned the use of PFAS substances in food packaging.
This guide document provides recommended testing methods for PFAS, such as total fluoride. If the total fluorine content is below 100ppm and meets quality control standards, the product can be considered as likely not intentionally adding PFAS substances. If the total fluorine content is very low (such as below 100ppm), further confirmation can be made with the supplier. The guideline document emphasizes that transparency is crucial for compliance, and it is recommended to use the following plan to confirm whether PFAS intends to add:
1) Ask suppliers for full material disclosure;
Require suppliers to provide comprehensive material disclosure;
2) Ask suppliers to close if PFAS chemicals are added;
Require suppliers to disclose whether PFAS substances have been added;
3) Look for third party certification of your materials
