On October 2nd, the US Environmental Protection Agency (EPA) proposed to add 16 individual PFAS and 15 PFAS categories (i.e. over 100 individual PFAS) to the toxic substance release list and designate them as chemicals of special concern.

Toxic Release Inventory (TRI) is a database created by the US EPA under Section 313 of the Emergency Planning and Community Right to Know Act (EPCRA).

TRI aims to track the management of certain toxic chemicals that may pose a threat to human health and the environment.

Since its first implementation in 1986, TRI has become an important tool for providing public information on the release and transfer of toxic chemicals.

It helps communities understand potential environmental health risks in their areas and promotes industry to take measures to reduce emissions of these chemicals.

At present, the TRI list contains 794 individual substances and 33 substance categories. If the production, processing, or other use of substances on the list exceeds a threshold, the company is required to report to the EPA regarding their disposal and emissions.

TRI Update Overview

The EPA's proposal to add 16 separate PFAS and 15 PFAS categories to TRI means that these substances must meet stricter reporting requirements, including reporting at lower concentrations.

The EPA also plans to set the reporting threshold for PFAS manufacturing, processing, and other uses at 100 pounds, which is consistent with the reporting requirements of other PFAS added to the TRI list under the 2020 National Defense Authorization Act (NDAA).

If ultimately determined according to the proposal, all PFAS in a given category will be included in the 100 pound reporting threshold for that category, and companies will not be able to avoid TRI reporting by using similar PFAS substances.

Recent additions to the TRI list PFAS:

9 new PFAS will be added in the 2023 reporting year; 7 new PFAS will be added in the 2024 reporting year; The 2025 reporting year requires the addition of 5 new PFAS.
